Florida Governor Signs CS/HB 463, Amending COVID Restrictions for Community Association Pools

Hollywood, Florida – (June 11, 2021) – Earlier this month, Florida Governor Ron DeSantis signed almost 30 bills into law.  Among them was CS/HB 463 Community Association Pools, which takes effect July 1, 2021 and will ease restrictions on certain swimming pools serving community associations throughout the state.

Primarily, CS/HB 463 amends Florida Statute 514.0115, which was also modified during the COVID-19 pandemic to protect public health. The provisions in this new legislation will soon provide Florida community associations with more autonomy, allowing exemptions from supervision or regulation by state and local departments of health.

It is important to note that this new law affects pools serving homeowners’ associations and other property associations that have no more than 32 units or parcels and are not operated as public lodging establishments. However, community associations must still comply with s. 514.0315, F.S. and are subject to ss. 514.05 and 514.06, F.S., which provide for necessary supervision to ensure water quality and compliance.

Nevertheless, as vaccinations roll out and COVID restrictions begin to loosen, the pandemic is not over. Despite progress toward normalcy, it is still important for community associations to follow guidelines that safeguard the health, safety and welfare of residents, along with protecting the association from possible liabilities.
